Privacy policy

1. Who we are & scope

BailSoft provides bail bond agency software and, through BailSoft Intelligence, a real-time feed of lawfully public county data. This policy covers two very different contexts:

• The bailsoft.com website and our pre-launch communications — where we are the business responsible for the limited personal information you give us (for example, when you request early access).
• The self-hosted BailSoft application — which each agency runs on its own infrastructure. Personal information processed inside an agency's deployment (defendant, indemnitor and bond records) is controlled by that agency, not by us; see the section on the self-hosted application below.

2. Personal information we collect

Through the website and our communications, we collect only what we need. Using the CCPA categories, this may include:

• Identifiers & contact details — your name, business email, phone number and agency name, when you request early access, a demo or launch updates;
• Professional information — your role, agency size, current software and state, if you choose to share it;
• Commercial information — records of your requests and communications with us;
• Internet or network activity — basic technical data your browser sends (IP address, device and browser type, pages viewed), used for security and aggregate analytics;
• Inferences — limited, such as which product areas you're interested in, drawn from what you tell us.

We do not collect defendant, bond, payment, biometric or precise-geolocation data through this website. Any such data is processed only inside an agency's self-hosted deployment, under the agency's control.

3. Where we get it

We collect personal information directly from you (forms and emails), automatically from your device when you visit the site, and, where applicable, from service providers that help us run the site and communications. We do not buy personal information from data brokers for marketing.

4. How we use it

We use the information above for these specific purposes:

• To respond to your enquiries and provide early access, demos and onboarding;
• To send launch updates you have requested (you can opt out at any time);
• To operate, secure, debug and improve the website and our communications;
• To understand aggregate interest in BailSoft and plan our rollout;
• To comply with legal obligations and enforce our terms.

We do not use your information for unrelated purposes, and we do not sell it.

5. Legal bases

Where a legal basis is required, we rely on your consent (for launch updates), our legitimate interests (to respond to enquiries and secure the site), the performance of a request you make of us, and legal obligation where applicable.

6. How we share it

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We disclose it only:

• To service providers / processors who host the site, deliver our email, or provide analytics — under contracts that limit them to our instructions;
• To comply with law, respond to lawful requests, or protect rights, safety and the integrity of our service;
• In connection with a business transfer (e.g., merger or acquisition), subject to this policy.

7. Your privacy rights

Depending on where you live, you may have the right to:

• Know / access the personal information we hold about you and how we use it;
• Delete your personal information;
• Correct inaccurate personal information;
• Data portability — receive a copy in a usable format;
• Opt out of any sale or sharing of personal information (we do neither);
• Limit the use of sensitive personal information;
• Non-discrimination for exercising your rights.

To exercise any right, email hello@bailsoft.com. We will verify your request and respond within the time your law requires. You may use an authorized agent where the law allows.

8. California privacy rights (CCPA/CPRA)

California residents have the rights above, plus the right to opt out of the “sale” or “sharing” of personal information and to limit the use of sensitive personal information. We do not sell or share your personal information, and we do not use sensitive personal information to infer characteristics. We honor browser Global Privacy Control (GPC) signals as opt-out requests. Under California's “Shine the Light” law, you may also request information about disclosures to third parties for their direct marketing — we make none. We do not knowingly process the personal information of individuals under 16 without required consent.

9. Other U.S. state privacy rights

Residents of states with comprehensive privacy laws — including Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana and others as they take effect — have comparable rights to access, delete, correct and port their data, to opt out of targeted advertising, sale and certain profiling, and to appeal a decision on their request. We extend these rights regardless of residency where practical. To exercise them, contact us as described above; if we deny a request, you may appeal by replying to our response.

10. Sensitive information

We do not seek sensitive personal information (such as government identifiers, precise geolocation, or biometric data) through the website, and we ask that you not send it to us. Sensitive data used by the product is processed only inside an agency's self-hosted deployment, under that agency's control and consent framework.

11. Data retention

We keep website and enquiry data only as long as needed for the purposes described here or to meet legal, accounting or security requirements, then delete or anonymize it. Launch-update subscriptions are kept until you opt out.

12. Cookies, analytics & Global Privacy Control

The site uses cookies and similar technologies needed to function, and Google Analytics (GA4) to understand aggregate website usage (for example, pages viewed and general location and device type). We do not use advertising or cross-site behavioral tracking. Google Analytics sets its own cookies and processes usage data as described in Google's policies; you can opt out through your browser settings or the Google Analytics Opt-out Browser Add-on, and we honor opt-out preference signals such as Global Privacy Control (GPC) where required.

13. Data security

We protect personal information with encryption in transit and at rest, access controls, and monitoring on our hosted systems. No method of transmission or storage is perfectly secure, but we work to protect your information and to limit who can access it.

14. Children's privacy

BailSoft is a business tool intended for adults. We do not knowingly collect personal information from children under 13 (or under 16 where a higher threshold applies). If you believe a child has provided us information, contact us and we will delete it.

15. Where data is processed

We process personal information on cloud infrastructure located in the United States. If you contact us from outside the U.S., you understand your information will be processed in the U.S. under this policy.

16. The self-hosted BailSoft application

The BailSoft agency application runs on each agency's own infrastructure. Personal information inside a deployment — including defendant, indemnitor, bond, payment and any monitoring data — is controlled by the agency, which is the business/controller for that data and is responsible for its own privacy notices, consents and responses to individuals. BailSoft acts, at most, as a software provider and does not receive that data. If you are a defendant, indemnitor or client and want to exercise rights over data held by an agency, contact that agency directly; we will help route a request where we can.

17. Changes to this policy

We may update this policy as our product and the law evolve. We will change the “last updated” date above and, for material changes, provide additional notice where required.
